JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2019 Heard the learned counsel for the petitioner and the learned A.P.P. appearing on behalf of the State. The present case is a second attempt on behalf of the petitioner for grant of regular bail in connection with Laheri PS case no. 72 of 2018 registered for the offences punishable under Sections 365, 366(A)/34 of Indian Penal Code. The allegation against the accused persons including the petitioner herein constitutes a grave offence of having abducted the victim girl and she, in her statement made under Section 164 Cr.P.C. before the learned Magistrate, has named the petitioner as the main accused person. It is also a fact that the prayer for bail made by the co-accused person, from whose house the victim girl was recovered, has already been rejected
Patna High Court CR. MISC. No.8829 of 2019(2) dt.17-04-2019 2/2 by a co-ordinate Bench of this Court by an order dated 04.07.2018 passed in Cr. Misc. no. 38603 of 2018 as is also reflected in the earlier order of this Court dated 23.07.2018 passed in Cr. Misc. no. 34281 of 2018.
I have heard the learned counsel for the petitioner, who could not point out any change in the circumstances from the time, the petition of the petitioner seeking grant of regular bail was rejected by this Court vide aforesaid order dated 23.07.2018, till date. This Court further finds that there are ample materials to prima facie constitute the offence as alleged against the petitioner herein and the petitioner has committed a grave offence of having kidnapped a minor girl. Having considered the gravity of the offence alleged to have been committed by the petitioner herein as also the fact that there is no change in the circumstances, this Court does not find any occasion to entertain the present petition, hence the same is dismissed.
