Petitioner is not named in the first information report but in course of investigation, name of the petitioner surfaced on the basis of information given by spy of the police and thereafter, one co-accused named the petitioner in his confessional statement. Petitioner was arrested and he, too, made confessional statement. Admittedly, except the aforesaid confessional statement, there appears to be nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge V, Muzaffarpur in Sessions trial no. 38/2015 arising out of Brahampura P.S. Case no. 208/2014.
