JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sasaram (Town) P.S. Case No. 555 of 2017 registered for the offences punishable under Sections 341, 323, 354-B of the Indian Penal Code.

Petitioner is not named in the first information report rather the first information report was lodged against son of Badre Alam. No doubt, petitioner is son of Badre Alam but there is nothing on the record to show that petitioner is only son of said Badre Alam. Moreover, the informant, herself, admitted in her written report that FIR named accused accidentally touched her and thereafter, a quarrel took place between them.

No.5098 of 2020(2) dt.03-03-2020 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram (Rohtas) in Sasaram (Town) P.S. Case No. 555 of 2017, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
