JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner. No one appears for the opposite party no.2 on repeated calls. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 498A and other allied sections of the Indian Penal Code.

Learned counsel for the petitioner, while referring to paragraph 11 of the bail petition, submits that the petitioner is ready to keep opposite party no.2 at this house with full dignity and honour.

Considering the aforesaid submission, let the petitioner, above named, in the event of surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond

Patna High Court CR. MISC. No.8170 of 2019(7) dt.03-03-2020 2/2 of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Darbhanga in Jalley Police Station Case No. 159/2018 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.

It is made clear that if the petitioner fails to abide by aforesaid undertaking, opposite party no.2 would be at liberty to approach the Court below for cancellation of bail. (Prabhat Kumar Singh, J) shashi/- U T
