The petitioner seeks regular bail in connection with Sonepur PS case no. 1150 of 2018 registered for the offence punishable under Sections 394, 412 of Indian Penal Code.

The allegation is regarding unknown miscreants having committed theft of mobile and motorcycle of the informant and thereafter, they fled away.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case after his name was disclosed by the co-accused persons and infact neither any recovery has been made from the conscious possession of the petitioner nor any test identification parade

Patna High Court Cr.Misc. No.6235 of 2019(2) dt.04-02-2019 2/2 has been conducted so as to connect the petitioner with the alleged crime. It is further submitted that though the petitioner is an accused in one other case but he is on bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 01.12.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Chapra in connection with Sonepur PS case no. 1150 of 2018.
