The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 324, 325, 307, 427, 504 and 506 of the Indian Penal Code. Allegation against the petitioner alongwith other accused persons is said to have assaulted the informant and his family members by lathi, danda and sharp weapons. It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case due to land dispute. There is general and omnibus allegation against the petitioner. The injuries of the injured are simple in nature except Mamta Devi who has received injury in grievous in nature but not in vital part. Learned APP for the State vehemently opposes the prayer for bail application.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court, in connection with Saraiya P.S.
