The petitioner apprehends his arrest in Haspura P.S. case No. 153 of 2018 registered under Section 323, 325, 308, 504 of the Indian Penal Code.
The informant, in gist, made allegation that he lent Rs. 12,000/- to the petitioner and when he went to demand money the petitioner assaulted him with Khanti on his head. The learned counsel for the petitioner submits that on account of relationship of lending and borrowing money the informant got enmity. While the informant was going through the road he fell down on the ground and received injuries on different parts of his body. The informant alleged that petitioner assaulted him with Khanti on his head but, besides the fact that injury found on the head of the informant is simple in nature,
Patna High Court Cr.Misc. No.7175 of 2019(2) dt.07-02-2019 2/2 the informant got three injuries, one on right elbow joint and 3rd as body ache which itself indicates that informant got injuries while he fell down on the ground.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub divisional Judicial Magistrate, Aurangabad in connection with Haspura P.S. Case No. 153 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
