This application for grant of regular bail arises out of Chandradeep P.S. Case No. 100 of 2019 registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code.
The petitioner is in custody since 28.09.2019. It is alleged in the First Information Report that the dead body of the informant's son was found lying in a field, who was found missing since the previous night i.e. 23.09.2019. The petitioner and co-accused Manu Khan @ Monu Khan were named in the First Information Report with the allegation that the deceased was last seen with them.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.4540 of 2020(4) dt.08-07-2020 2/2 petitioner has submitted that co-accused Manu Khan @ Monu Khan has been allowed regular bail by this Court by an order dated 29.05.2020 passed in Cr. Misc. No. 4462 of 2020. He has submitted that there is no material, which can distinguish accusation against this petitioner and that against the said coaccused Manu Khan @ Monu Khan. Learned counsel representing the informant, while opposing the prayer for regular bail, has failed to make out any distinction between the case of this petitioner and the coaccused Manu Khan @ Monu Khan, who has been granted regular bail by this Court.
Considering the facts and circumstances, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Jamui, in Chandradeep P.S. Case No. 100 of 2019.
