Petitioner is not named in the first information report but in course of investigation, the informant's son gave information to I.O about the stolen motorcycle as well as petitioner who was caught by the informant's son and others along with stolen motorcycle. The I.O went there and recorded statement of informant's son who claimed that he saw the petitioner going with the stolen motorcycle and after that he chased the petitioner who started fleeing away from there leaving behind the stolen motorcycle but he was caught by the informant's son and others. Petitioner does not have any criminal antecedent and according to the statement of informant's son, the alleged recovery has not been made from conscious possession of the petitioner.

Patna High Court Cr.Misc. No.33913 of 2015 (4) dt.24-11-2015 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class Muaffarpur in connection with Kudhani (Turki O.P.) P.S.Case No. 150 of 2015.
