The petitioner seeks regular bail in connection with Bakhtiyarpur PS case no. 135 of 2018 registered for the offence punishable under Sections 395, 412 of Indian Penal Code.

The allegation is regarding the accused persons having apprehended the vehicle of the informant whereafter they sat inside the vehicle, however they were intercepted and apprehended by the police on the same day.

The learned counsel for the petitioner has submitted that the co-accused person, on the basis of whose statement, the name of the petitioner has transpired in the present case, has already been granted bail by a co-ordinate

Patna High Court Cr.Misc. No.5811 of 2019(2) dt.01-02-2019 2/2 Bench of this Court vide order dated 24.01.2019 passed in Cr.Misc. no. 75786 of 2018, hence the petitioner be also admitted to the privilege of regular bail. Lastly, it is submitted that the petitioner is having a clean antecedent and is languishing in custody since 07.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM. Barh, Patna in connection with Bakhtiyarpur PS case no. 135 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
