JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 The petitioner apprehends his arrest in connection with Chanpatia (Sirisia OP) P.S.Case No. 383 of 2018 registered under Section 414 of the Indian penal Code.

Allegation against the petitioner is of recovery of 09 litres country made liquor from motorcycle without any number. Submission of learned counsel for the petitioner is that motorcycle does not belong to the petitioner and he has falsely been implicated in this case.

Heard learned APP also who has opposed the prayer of anticipatory bail stating that there is allegation of recovery of liquor as well as stolen motorcycle from the petitioner. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender

Patna High Court CR. MISC. No.7097 of 2019(3) dt.04-04-2019 2/2 within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
