The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 427, 471, 467, 468, 420/34 of the Indian Penal Code.

The prosecution case is that the accused petitioners are claiming the land of the informant on the basis of a forged sale deed.

It is submitted by the learned counsel for the petitioners that petitioners are claiming the land as ancestral one on the basis of their names being recorded in the revenue records whereas the informant claimed the land by virtue of

Patna High Court Cr.Misc. No.29952 of 2015 (2) dt.29-07-2015 sale deed dated 28.10.2010. In 144 Cr.P.C. proceeding the issue was disposed with observation to get the issue decided by competent civil court but thereafter the present criminal case was lodged.

Considering the nature of accusation, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahishi P.S. Case No. 131 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
