The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/341/307/302 of the Indian Penal Code and Section 27 of the Arms Act. According to FIR, co-accused Amerika Singh, Chandreshwar Singh, Bachu Singh and Opiya allegedly fired at deceased Sankar Mandal and caused injury and death. Petitioner was also member of unlawful assembly. Petitioner is in custody since 30.08.2018. The petitioner has stated on oath that he has got no criminal antecedent.
Considering the nature of allegation and the facts aforesaid, let the petitioner, above named, be released on bail on
Patna High Court CR. MISC. No.5434 of 2019(3) dt.19-04-2019 2/2 furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with SessionsTrial No.986B of 1999, arising out of Bariyarpur P.S. Case No.122 of 1998, with condition that petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
