====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-05-2023 Heard Mr. Binod Kumar, learned counsel for the petitioner and Mr. Sanjay Kumar, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Khagaria (Muffasil) P.S. Case No. 548 of 2022 dated 12.6.2022 registered for the offence punishable under Section 395 of the Indian Penal Code 1860.

As per the First Information Report, while the informant was coming on a Motorcycle along with his friend, he was accosted by six miscreants sitting on a Motorcycle who snatched a sum of Rs.3,79,000/- from the possession of the informant.

Learned counsel for the petitioner submits that the

No.8579 of 2023(2) dt.10-05-2023 2/3 First Information Report is against unknown and the name of the petitioner has transpired during course of investigation on the basis of confessional statement made by the co-accused Prince Kumar. He further submits that the petitioner is in custody since 14.6.2022 but no Test Identification Parade has been conducted by the Police. He next submits that other co-accused persons whose name also transpired on the basis of confessional statement have been granted bail by co-ordinate Benches of this Court in Cr. Misc 4683 of 2023 and 3030 of 2023 respectively. Regards being had to the submission made by the parties and taking into consideration the nature of allegation and the fact that the petitioner has got no criminal antecedent, he is in custody since 14.6.2022, other coaccused persons have been granted Bail by this Court and charge sheet has been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
