The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 45 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received of one Ashok Paswan having stored liquor in his house, a raid was conducted. It is stated that the police personnel were violently attacked by group of 200 accused persons resulting in injury to two police personnel. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is in custody since 31.10.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegations against the petitioner, grant of bail to co-accused Ashok Paswan and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Hajipur Town P.S. Case no. 423 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court, no. 1-cum-Addl. District and Sessions Judge, Vaishali at Hajipur. (Partha Sarthy, J) Prakash/- U
