1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and is Secretary of Ward No. 5. It is next submitted that the thrust of the allegation in the FIR is that the petitioner failed to provide documents for verification with respect to the work done worth Rs. 23,35,000/- under CM Rural Nali Gali Pakkikaran Nischay Yojna. It is next submitted that a certificate case was also instituted against the petitioner with respect to the allegations as alleged in the FIR, but the certificate case was dropped after the

Patna High Court CR. MISC. No.11824 of 2024(2) dt.07-03-2024 2/2 informant submitted his report before the Certificate Officer as would manifest from Annexure P-5 to the supplementary affidavit. It is also submitted that similarly situated co-accused persons have granted the privilege of anticipatory bail by an order dated 10.11.2023 in Criminal Miscellaneous No. 73155 of 2023 by a learned Co-ordinate Bench.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Raghopur P.S. Case No. 78 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
