JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2019 The petitioners apprehend their arrest in connection with Special Case No. 1219 of 2018 arising out of Narpatganj P.S.Case No. 584 of 2018 registered under Sections 30(a), 38(2) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of four and half litres of liquor from a Government Flat and during investigation name of the petitioners were disclosed.
Submission of learned counsel for the petitioners is that said flat does not belong to the petitioners and they have no criminal antecedent.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within
Patna High Court Cr.Misc. No.7026 of 2019(2) dt.06-02-2019 2/2 a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions-cum-Special Judge, Araria in connection with Special Case No. 1219 of 2018 arising out of Narpatganj P.S.Case No. 584 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
