JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2019 This is an application for grant of anticipatory bail in connection with Baniyapur Police Station Case No. 379 of 2018, disclosing offences under Sections 304(B), 34 of the Indian Penal Code.

Allegation against the petitioners, who happen to be the father-in-law and mother-in-law of the deceased, is of committing dowry death of the deceased.

Submission of learned counsel for the petitioner is that no specific allegation has been attributed against these petitioners and the whole family members have been made accused in this case and other co-accused persons, who are Bhaisur and Gotni have already been granted privilege of anticipatory bail by a Coordinate Bench of this Court vide order

Patna High Court CR. MISC. No.10059 of 2019(3) dt.25-04-2019 2/2 dated 05.02.2019 passed in Cr. Misc. No. 6414 of 2019. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Xith, Saran at Chapra in connection with Baniyapur Police Station Case No. 379 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
