The petitioner seeks bail in Natwar P.S. case no. 95/18 instituted for the offence under Sections 30(a) and 32 (c) of Bihar Prohibition and Excise Act, 2016. Learned counsel for petitioner submits that there is no recovery of any foreign liquor from conscious possession of this petitioner. He is named in the FIR on the basis of suspicion. In the written report, it is alleged that police apprehended one car coming rashly near Karaundi Canal and same met with accident when trying to run away on seeing the police party. One person was apprehended and other managed to run away. The apprehended person was petitioner. It is further alleged that 397.440 litres of liquor has been recovered from the

Learned counsel for petitioner submits that petitioner is neither the owner nor driver of the alleged car. He was sitting on the aforesaid car as a passenger.

Petitioner is in custody since 10.11.2018 having no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum Special Judge (Excise Act) Rohtas at Sasaram, in connection in Natwar P.S. case no. 95/18 subject to the condition that both the bailors shall be the close relative of the petitioner.
