====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 19-02-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Fatuha P.S. Case No. 572 of 2023 instituted under Sections 323, 341, 307, 504 and 34 of the Indian Penal Code.
3. As per the prosecution case, while the informant was on his way to his home from the market one Sanjay Kumar who was drunk, abused him and after objection the petitioner and Raushan Kumar assaulted the informant with lathi, danda and brick.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. The allegation against the petitioner is general in nature. The chargesheet against the other co-accused persons have already been

He further submits that petitioner and informant are of the same village and there is dispute regarding flow of dirty water. There is no criminal antecedent against the petitioner. He is ready to cooperate in the investigation.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to each to the satisfaction of the learned A.C.J.M.-I, Patna City in connection with Fatuha P.S.
