The petitioner is in custody in connection with Kothi P.S. Case No. 51 of 2018, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits petitioner has no criminal antecedent. He further submits that the name of the petitioner was disclosed by Chaukidar. Learned counsel for the petitioner further submits that petitioner is in custody in this case on 29.10.2018. He further submits that in the instant case total 36 liter Mahua Wine was recovered. Learned counsel for the petitioner further submits that petitioner is not at all connected with trade of liquor.

No.2999 of 2019(2) dt.23-01-2019 2/2 Considering the facts that petitioner has no criminal antecedent and period of custody since 29.10.2018, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge Excise, Act, Gaya in connection with Kothi P.S. Case No. 51 of 2018, subject to the conditions that one of the bailor should be elected representative of the local body.
