The petitioner apprehends his arrest in connection with Saharsa P.S. Case No. 639 of 2017 for the offence punishable under Sections 302, 120/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the co-accused having more or less similar allegation has already been granted anticipatory bail by different co-ordinate Benches of this Court in Cr. Misc. No. 47225 of 2017, Cr. Misc. No.53798 of 2019 and Cr. Misc. No. 50478 of 2019 which is evident from
Patna High Court CR. MISC. No.4242 of 2020(2) dt.29-06-2020 2/2 Annexures- 3,4 and 5 of the application and the case of this petitioner stands on similar footing. Hence, the petitioner may be granted the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the, above named, petitioner in the event of his arrest or surrender before the court below within a period of four weeks be released on bail on furnishing his personal bond to the satisfaction of the learned Judicial Magistrate1st, Class, Saharsa in connection with Saharsa P.S. Case No. 639 of 2017 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
