Petitioners are accused in connection with Bhorey P.S. Case No. 282 of 2012 registered under Sections 380, 461 and 411 of the I.P.C.
Regarding theft of 2.5 kg. silver and 35 gm. gold ornaments from the shop of informant, F.I.R. was lodged on the basis of written report of informant, Sushil Verma. Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.22988 of 2015 (5) dt.01-10-2015 2/2 petitioners submits that petitioners are not named in the F.I.R. and in course of investigation, the name of the petitioners have come in the confessional statement of co-accused Khem Singh, as detailed in paragraph no.87 of the case diary, on whose statement stolen articles are said to be recovered. Except that, there is nothing against the petitioners. It is also submitted that co-accused Khem Singh has already been allowed bail on 15.01.2014 by the Court of 1st Additional Sessions Judge, Gopalganj vide B.P. No. 08 of 2014. It is further submitted that petitioners are in custody since 13.03.2015 and 02.04.2015 respectively. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Gopalganj in connection with Bhorey P.S. Case No.282 of 2012. Out of two sureties, one surety must be parents or close relatives of the petitioners, who will also file an affidavit before the Court below about the relationship with the petitioners.
