Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302, 307, 323, 324, 341, 447, 504 of the Indian Penal Code. Petitioner is in custody since 18.07.2018. Allegation is that he assaulted with Lathi causing injury at the head of Lakhan Mahto, as a result whereof, Lakhan Mahto died during course of treatment. The Doctor has found head injury caused by hard and blunt substance on the person of the deceased.

Submission is that there is no allegation of repetition of blow. Petitioner has got no criminal antecedent and

Considering the entire facts, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Warisnagar Police Station Case No.133 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
