====================================================== CORAM: HONOURABLE MR. JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 04-01-2022 Heard the parties through video conferencing. The petitioner apprehends his arrest in connection with Hilsa P.S. Case No. 267 of 2020, corresponding to G.R. No. 1363 of 2020 registered for the offence under Sections 147, 148, 149, 323, 504, 307 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that no injury has been caused by any firearm and the allegation of the informant of having caused injury by weapon used by the petitioner, is not made out as there is no injury on the informant. Learned counsel further submits that so far as other accused are concerned, the allegations of causing injury is on the forehead relating to other injured persons.

Patna High Court CR. MISC. No.19705 of 2021(3) dt.04-01-2022 2/2 So far as petitioner is concerned, he has been wrongly roped in the case and he deserves to be granted anticipatory bail. I have considered the submission and found from the nature of allegation and the antecedent which has occurred, it is apparent that there were several persons dispossessing firearm, allegation is also against the petitioner of having fire-arm. In view, thereof, I am not inclined to grant benefit of anticipatory bail to the above named petitioner. Accordingly, the prayer for anticipatory bail is rejected.
