This application for grant of anticipatory bail arises out of Sheohar P.S. Case No. 19 of 2016, disclosing offences under Sections 224,225, 353/34 of the Indian Penal Code. The allegation in the First Information Report is that the petitioner was apprehended by the Excise officials for commission of offence under the provisions of the Bihar Excise Act. It is alleged that while the petitioner was in custody, 30 to 35 persons surrounded the barrack and after assaulting Excise employees and Home Guard, took away the petitioner. With such allegation against this petitioner, this application for anticipatory bail cannot be allowed. This application is rejected.

The petitioner is directed to surrender before the

Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
