JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-03-2018 The present writ petition has been filed with a prayer to direct the respondent no. 4 i.e. the C.D.P.O., Nawada Sadar, Nawada to issue appointment letter to the petitioner herein for the post of Aanganwari Sevika.
It is apparent from the records that by an order dated 12.02.2018 notice was issued to the respondent no. 5, the candidate whose selection was found to be illegal. The learned counsel for the respondent no. 5 has appeared before this Court and informs this Court that the respondent no. 5 has filed an appeal before the Collector, Nawada and the next date fixed in the said case has been fixed for 03rd April, 2018.
In view of the aforesaid, the parties are in agreement that the present writ petition can be disposed off with a direction
Patna High Court CWJC No.13493 of 2017 (3) dt.08-03-2018 2/2 to the Collector, Nawada to finally hear the parties including the petitioner herein as well as the respondent no. 5 and dispose off the appeal on 03rd April, 2018 itself. The respondent no. 5 is directed to bring to the notice of the Collector, Nawada about the passing of the present order so that the Collector can arrange for the records of the case prior to the hearing scheduled on 03.04.2018. It is further directed that the petitioner, if so advised, may file a reply before the Collector, Nawada within a period of three weeks from today. It is also directed that in order to enable the petitioner to file a reply to the appeal filed by the respondent no. 5, the petitioner may approach the Collector, Nawada within a period of one week from today and the Collector, Nawada shall hand over a copy of the appeal to the petitioner herein.
It goes without saying that the consequences emanating from the final decision being so passed by the appellate Court shall follow.
