JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2019 Heard learned counsels for the petitioner and State. The petitioner is languishing in custody since 23.10.2018 in a case registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

On secret information received by the informant being the A.S.I. of Deepnagar P.S. is to the effect that near the house of Prince Kumar, two persons are sitting with arms, raid was laid, on seeing the police party, two persons started fleeing away, but the petitioner was intercepted and from his possession, one loaded pistol was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been framed in the present case. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that recovery has been made from

Considering the fact that investigation has already been concluded and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Deep Nagar P.S.
