JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hajipur P.S. Case No. 583 of 2019 registered for the offences punishable under Sections 392, 412 of the Indian Penal Code. According to the prosecution case, the stolen truck and other articles were recovered from the front of house of the maternal grand father of the petitioner and on query maternalgrand -father of the petitioner disclosed that it was petitioner, who parked the stolen truck and articles.
Learned counsel for the petitioner submits that petitioner has some dispute with his maternal-grand-father and that is the reason his maternal-grand -father falsely implicated the petitioner in this case.
Patna High Court CR. MISC. No.5186 of 2020(2) dt.03-03-2020 2/2 Regard being had to the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner and according, his prayer for bail in connection with Hajipur Sadar P.S.Case No. 583 of 2019, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur stands rejected.
However, if the petitioner surrenders and seeks regular bail within six weeks from today, the concerned court shall consider the regular bail on its own merit without being prejudiced by this rejection order.
