The petitioner seeks bail in Digha P.S. Case No. 37 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and Sections 3(i)(x) of the SC/ST Act.

The informant alleged that his father had gone to take toddy but there was some altercation. Ramraj Rai, Toofani Rai and Sahai Rai, the petitioner assaulted his father but his father died during the course of treatment.

It is submitted that Ramraj RAi has already been granted bail vide order passed in Cr. Misc. No.21764 of 2014 and Toofani Rai has been granted anticipatory bail. The case of the petitioner stands on the same footing.

Patna High Court Cr.Misc. No.34663 of 2014 (3) dt.16-01-2015 Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Miss Akansha Kashyap, the learned Judicial Magistrate, 1st Class, Patna in connection with Digha P.S. Case No. 37 of 2014.
