Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of eight weeks.

The present application has been filed for modification of the order dated 24-02-2021 passed in Cr. Misc. No. 33216 of 2020 by which the petitioners were granted anticipatory bail in connection with Amarpur P.S. Case No. 149 of 2020 pending in the court of learned Chief Judicial Magistrate, Banka. Supplementary affidavit has been filed in modification application on behalf of the petitioners. Same be kept on record. It has been submitted that inadvertently, the names of

Patna High Court CR. MISC. No.5865 of 2022(2) dt.02-03-2022 2/2 father of the petitioner Nos. 1 & 2 have wrongly been mentioned as "Ganesh Choudhary" and "Naresh Choudary" whereas it should be vice versa as "Naresh Choudhary" and "Ganesh Choudhary".

Accordingly, the order dated 24-02-2021 passed in Cr. Misc. No. 33216 of 2020 is modified to the extent that in the cause title of the order, the names of father of petitioner Nos. 1 & 2 be read as "Naresh Choudhary" and "Ganesh Choudhary" respectively. Further the period of surrender of the petitioners in the court below is extended for a further period of eight weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 24-02-2021 passed in Cr. Misc. No. 33216 of 2020.

The order dated 24-02-2021 passed in Cr. Misc. No. 33216 of 2020 is modified to the extent as indicated above. The modification application is, accordingly, disposed of. (Sudhir Singh, J) A.K.V.//- U T
