This application, for grant of regular bail, arises out of Mirganj P.S. Case No. 349 of 2015, disclosing offences under Sections 341, 323, 324, 308, 447 and 504/34 of the Indian Penal Code.

The petitioner is in custody since 19.03.2016. Referring to the F.I.R., learned counsel for the petitioner has submitted that the land dispute is the reason behind some occurrence, for which the case and counter case have been filed. It has further been submitted that co-accused Rajesh Yadav has been granted anticipatory bail vide order dated 13.04.2016 passed in Criminal Miscellaneous No. 9707

Patna High Court Cr.Misc. No.23108 of 2016 (2) dt.26-05-2016 2/2 of 2016. It has further been submitted that the petitioner's case is on better footing to that of Rajesh Yadav. Considering the submission, as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 349 of 2015.

This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
