JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-379/411/34 of the Indian Penal Code. Petitioner and one Jitnarayan Yadav were caught at Patna Railway Station Platform whereas; the alleged occurrence is said to have taken place in a running train near Masaurhi. The informant claimed that he had kept Rs. 20,000/- cash, voter I card, ATM card and Driving Licence, which was stolen. It is alleged that Rs. 12,500/- in cash and voter I card of informant were recovered from possession of the petitioner whereas; Rs. 7500/- in cash is said to have been recovered from possession of co-accused Jeet Narayan Yadav and so far as ATM cards are concerned; the petitioner and co-accused disclosed that they had thrown the
Patna High Court Cr.Misc. No.21972 of 2016 (2) dt.20-05-2016 2/2 aforesaid item from a running train.
Submission on behalf of petitioner is that nothing was recovered from conscious possession of the petitioner and as a matter of fact, the petitioner was caught on mere suspicion and after that, putting voter I card of the informant, the police booked the petitioner in this case and so far as so called seized cash is concerned; the same is said to be handed over to the informant. Considering the above-said facts and circumstances of the case as well as submission of the parties and also, taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patna Junction G.R.P.S. Case No. 15 of 2016 to the satisfaction of learned Railway Judicial Magistrate, Patna.
