JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-12-2021 At the outset, learned counsel for the petitioners submits that petitioner no. 2, Ramadhin Kumar has been arrested during pendency of this application, and as such, he seeks permission to withdraw this application as against him.

Permission is granted.

The application, thus, stands dismissed as withdrawn as against the petitioner no. 2.

Heard learned counsel for the petitioner and the State.

Petitioner apprehends arrest in connection with Dulhin Bazar P.S. Case 111 of 2019 registered for the

Patna High Court CR. MISC. No.7192 of 2020(7) dt.14-12-2021 2/2 offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing specific is alleged against this petitioner. The specific allegation is against Umesh Yadav, Manibhaskar Kumar and Vimal Yadav. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner no.1, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Judicial Magistrate, 1st Class, Danapur in connection with Dulhin Bazar P.S. Case No. 111 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
