The petitioner apprehends her arrest in connection with Giriyak / Katarisarai PS Case No. 39 of 2022 dated 27-12022 registered under Section 467, 468, 471, 420 and 120B of the IPC.

As per the FIR the petitioner has allegedly obtained appointment as Contract Block Teacher on the basis of forged mark sheet of Matriculation.

Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged and as per the FIR during course of vigilance enquiry it has been found that there is mismatch in the marks of the petitioner. He next submits that allegation against the petitioner is based upon

Patna High Court CR. MISC. No.9025 of 2023(2) dt.19-05-2023 2/2 documents and there is no likelihood that the petitioner will abscond or tamper with the evidence. The petitioner is a lady . Regard being had to the submission made by the parties, taking into consideration the fact that allegation against the petitioner is based upon documents, custodial interrogation of the petitioner may not be necessary, there is no likelihood that petitioner will abscond or tamper with the evidence and petitioner is a lady, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 1st , Nalanda in connection with Giriyak / Katarisarai PS Case No. 39 / 2022 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
