JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One Sonu Kumar @ Sanni is named in the first information report and it is alleged that the aforesaid Sonu Kumar @ Sanni demanded extortion money from the informant. In course of investigation, call details of mobile numbers, as given in the first information report, were taken up and it came to light that the SIMs of the said mobiles were to be of others. Subsequently, Rajesh Kewat was examined but police made the petitioner accused on the ground that the same Modus operandi had been adopted by the accused of Ram Krishna Nagar P.S.Case No. 130 of 2015 and, accordingly, petitioner was remanded in this case on 7.9.2013 and since then he is languishing in jail custody.

Patna High Court Cr.Misc. No.24081 of 2016 (3) dt.14-07-2016 2/2 Submission on behalf of the petitioner is that except suspicion, there is nothing against the petitioner and having more or less similar allegation, some co-accused have already been granted privilege of bail.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Ram Krishna Nagar P.S.Case No. 168 of 2015.
