JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but informant claimed only to this extent that when she came out of her house, she saw the petitioner and other FIR named accused fleeing from the place of occurrence having firearms in their hands. In course of investigation, some witnesses vide paragraphs no. 15 and 42 of the case diary claimed themselves to be eye witness of the alleged occurrence and stated that petitioner and two others made indiscriminate firing causing death of the deceased. Admittedly, co-accused, Teema Mandal @ Teva Mandal @ Chandra Bhanu Mandal has already been granted

Patna High Court Cr.Misc. No.29864 of 2015 (3) dt.27-10-2015 2/2 privilege of bail by a co-ordinate Bench of this Court. No doubt, several firearm injuries were found on the person of the deceased but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Bhagalpur in connection with Sessions Trial No. 103 of 2015 arising out of Kahalgaon (Ghogha) P.S.
