JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 This is an application for grant of anticipatory bail in connection with Saraiya P.S. Case No. 452 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 325, 354, 337, 338, 307 and 302 of the Indian Penal Code. Allegation against the petitioners and several other accused persons is that they came over the land in dispute and assaulted the informant, his son and others by lathi and danda. No.5882 of 2019(3) dt.01-04-2019 2/2 that no specific allegation has been attributed against any of the petitioner and one of the injured, who made the statement before the police in the hospital and has not named these petitioners and furthermore, the postmortem report shows only three injuries on the person of the deceased.

Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, West Muzaffarpur, in connection with Saraiya P.S.
