On behalf of the Bihar School Examination Board counter affidavit has been filed and in para-12 specific stand has been taken by the Bihar School Examination Board that the Board is taking steps for constitution of regular governing body. Para-12 of the counter affidavit is quoted below:- "That still with the intent to constitute governing body and a regular managing
Patna High Court CWJC No.12215 of 2017(3) dt.02-08-2019 2/2 committee for the institution in question that it was vide letter dated 24.01.2018 that query had been made from the Convenor with regard to the present status of the donors of the institution in question. A reminder in this regard had also been sent vide memo no. BSEB (SS)/Coll-Estab 106/12.2.2019 has also been sent to the concerned District Education Officer with a request for further needful in the matter."
In view of the specific stand of the Examination Board, the writ petition is disposed of with direction to the Examination Board to constitute the regular managing committee in terms of their own stand at para 12 of the counter affidavit which is quoted hereinabove within a period of sixty days from the date of receipt/production of a copy of this order. In the process if the Board requires any document or information from the petitioner, the petitioner shall provide such document or information immediately on request made by the Examination Board. The petitioners themselves may submit those information or document which the petitioners feel relevant for the purpose of constituting managing committee. With the aforesaid, the writ application stands disposed of.
