2. The accused-petitioner, named in the F.I.R., is apprehending his arrest in connection with (Chautarwa) Bathwariya P.S. Case No. 255 of 2023 registered for the offences punishable under Sections 341, 323, 324, 307, 380, 354, 447, 448, 504 and 34 of the Indian Penal Code. He has one criminal antecedent, in which he is on bail, as stated in paragraph '3' of the application.
3. Allegation against the petitioner is to assault the informant and other family members causing bodily injury and also taking away cash of Rs. Seven Lakhs and other valuable articles from the house of the informant.
4. It is submitted by learned counsel appearing on behalf

No.8797 of 2024(2) dt.20-02-2024 2/2 of the petitioner that allegation as to cause assault by knife is apparently false as the injured received injuries during course of scuffling as to fall on utensil stored there. It is further pointed out that petitioner is agnate of the informant, where occurrence took place out of altercation regarding a mobile alleged to be stolen by the wife of the petitioner. The petitioner further found involved in one more criminal case of petty nature in which he is on bail.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Having regard to the facts and circumstances of the case and by taking note of nature of injuries and the allegation in totality, in case of his arrest/surrender within a period of four weeks from today, let the petitioner above-named be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.D.J.-cum-Special Judge, Excise, Bagaha, West Champaran in connection with (Chautarwa) Bathwariya P.S. Case No. 255 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
