Petitioner has prayed for a direction to the District Magistrate, Gaya (Respondent No. 3) for disposing off the Anganwari Appeal No. 17 of 2016 expeditiously, preferably within a period of one month, as the appeal was preferred sometimes in the year 2016.

The petitioner has raised objection with respect to engagement / appointment of Respondent No. 6 on the post of Anganwari Sewika in Daulatpur Ward No. 3 on the ground that such employment was obtained by Respondent No. 6 by

Patna High Court CWJC No.1653 of 2019(2) dt.31-01-2019 2/2 impersonating and by furnishing fake educational certificate. The District Programme Officer, Gaya is alleged to have disposed off the objection of the petitioner in a casual and cavalier manner against which the appeal referred-to-above, has been filed by the petitioner.

The District Magistrate, Gaya, on receipt of the appeal directed the CDPO to submit an enquiry report which is also reported to have been submitted. Despite this, the District Magistrate has not passed any order in the appeal filed by the petitioner.

Under such circumstances, the Respondent No. 3 / the District Magistrate, Gaya is directed to dispose off the appeal of the petitioner by passing a speaking order within a period of eight weeks, to be counted from the date of production/communication of a copy of this order. With the aforesaid observation / direction, this writ petition stands disposed off..
