The petitioner is in custody in connection with G.O. Case No. 151/18 registered for the offence punishable under Section 30 (A) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. He further submits that in the instant case total 49.500 liter of Nepali Saufi wine was seized. Learned counsel for the petitioner next contended that mandatory provision of Section 100 Cr.P.C. was not followed in preparation of seizure list. He submits that petitioner is in custody since 02.12.2018.

Considering the fact that petitioner has no criminal

No.7889 of 2019(2) dt.11-02-2019 2/2 antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional District and Sessions Judge, II- cum Special Judge, Excise Act, Sitamarhi in connection with G.O. Case No. 151 of 2018.
