JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-05-2016 Heard the learned counsel for the petitioners as well as the learned A.P.P for the State.
The petitioners seek bail in a case for the offences punishable under sections 147, 148, 149, 341, 323, 307, 427, 385, 387, 504 and 506 of the I.P.C and section 27 of the Arms Act. Allegedly, the petitioners and other co-accused named in the FIR along with 20-30 unknown started opening indiscriminate firing and further damaged the truck and other articles. Co-accused Kunal Gaurav @ Kunal Kumar and Subodh Kumar Singh @ Subodh Kumar have also demanded extortion money of Rs. 50,00,000/-.
Patna High Court Cr.Misc. No.21007 of 2016 (3) dt.24-05-2016 2/2 Submission is of false implication and that the dispute appears purely of contractual nature related to storage of foodgrains in the warehouse, no fire arm injury was caused to any one, co-accused Kunal Gaurav @ Kunal Kumar and Subodh Kumar Singh @ Subodh Kumar have already been allowed bail vide Cr. Misc. Nos. 19548 of 2016 and 22045 of 2016 by another coordinate Benches of this Court and as such the petitioners also deserve sympathetic consideration, to which the learned A.P.P. does not dispute.
In the facts and circumstances as stated above, the petitioners are also directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Begusarai in Begusarai Muffasil (Lakho) P.S. Case No. 110 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
