Heard counsel for the petitioner and counsel appearing on behalf of the State.
The petitioner is apprehending arrest in connection with Fatuha P.S. Case No. 784 of 2018 for offences under Sections 498(A), 341, 323/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case marriage took place in the year 2011. Counsel drew the attention of this Court on paragraph - 11 of the bail application to the
Patna High Court CR. MISC. No.7162 of 2020(2) dt.29-02-2020 2/2 effect that the petitioner is ready to keep his wife with full honour and dignity.
Considering the aforesaid, the court is inclined to grant bail to the petitioner. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the ACJM V, Patnacity, Patna in connection with Fatuha P.S. Case No. 784 of 2018, subject to the conditions as laid down under Section 438(2) Cr. P. C.
After release of the petitioner, the court below shall refer the matter to the District Mediation Center for settlement of the dispute between the husband and wife amicably. (Anil Kumar Upadhyay, J) spandey/- U T
