BAJANTHRI) 16-02-2024 The present MJC-Contempt petition is filed for noncompliance of order dated 19.07.2021 passed in CWJC No. 8108 of 2021.

2. Direction is to the petitioner to submit a representation and thereafter such representation was required to be considered by the Block Development Officer, Patepur, District-Vaishali at Hajipur. Petitioner had submitted a representation on 13.08.2021 as the same has not been considered for these many years. Certain inquiries were stated to have been initiated with reference to the petitioner's representation and it is stated to have attained finality in respect

Thereafter, certain directions have been undertaken with reference to initiation of recovery proceedings against such of those alleged persons vide order dated 26.04.2023. The same was apprised to the petitioner on 08.02.2024 by means of a notice. The petitioner could not appear in person. Consequently, the Block Development Officer proceeded to pass order on 09.02.2024.

3. Having regard to these development, there is some compliance to the orders of this court. There is a delay in complying orders of this Court for which there was no explanation or have they sought for extension for time from this Court insofar as compliance of the orders of this Court. If there are serious lapses in respect of misappropriation of government fund and in such matters if there is a PIL and orders have been passed by this Court, still the official respondents are sleeping over the matter for years together for the purpose of compliance of orders of this Court. Therefore, they are liable to pay litigation cost and it is quantified at Rs. 10,000/-(Rupees ten thousand only). Cost shall be paid to the petitioner. If there is no finality in the present proceedings, petitioner is at liberty to file interlocutory application to revive this order after six months.

4. Accordingly, the present MJC-Contempt petition

Patna High Court MJC No.139 of 2022(4) dt.16-02-2024 3/3 stands disposed of.
