The petitioner is in custody in connection with Patliputra P.S. Case No. 541 of 2018 for the offence under Sections 25(1-b)a/26,35 of the Arms Act and Section 37 (b) (c) of the Bihar Prohibition and Excise Act 2016. Learned counsel for the petitioner submits that nothing were recovered from the possession of this petitioner. In fact, the co-accused from whose flat recovery was made has been granted bail by co-ordinate Bench of this Court. Counsel for the petitioner further submits that petitioner is a student and he has no concern with the seized pistol in the instant case. Considering the fact that pistol was not recovered

No.5768 of 2019(2) dt.05-02-2019 2/2 from the possession of this petitioner, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Special Judge, Excise, Patna in connection with Patliputra P.S. Case No. 541 of 2018, subject to the condition that both bailors should be government employee.
