Petitioner seeks bail in a case registered for the offences punishable under Sections 399,400,402,411 of the Indian Penal Code and 25(1-b)A,26 and 35 of the Arms Act. From possession of the petitioner, a country made pistol and live cartridges were recovered. Petitioner is in custody since 13.08.2020. Petitioner has got two criminal cases pending against him. Investigation of the case is already complete.
Considering the facts of this case, let the petitioner, above named, be released on bail after framing of the charges so that the trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like
Patna High Court CR. MISC. No.16029 of 2021(3) dt.29-09-2021 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Kudra Police Station Case No.244 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
