2. The petitioner seeks regular bail in connection with Kanti P.S. Case No. 407 of 2023 registered on 05.06.2023 lodged under Sections 395/397 of the I.P.C.
3. As per the prosecution case, F.I.R. has been lodged against five unknown accused persons.
4. Counsel for the petitioner submits that petitioner was arrested in Kanti P.S. Case No. 442 of 2023 and in the present case he has been remanded. He further submits that neither incriminating substance has been recovered from the possession of the petitioner and not he was put on T.I.P.
5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner

No. 7320 of 2024(2) dt.17-02-2024 2/3 is in custody since 26.07.2023 having three criminal case pending against him, in which he is on bail in two case and in one case, he is persuading for bail. Counsel submits that one country made pistol and one live cartridge has been recovered from the possession of the petitioner as well as fake currency not has also been recovered from the petitioner but for this recovery there is already a case pending against him.
6. Learned counsel for the State opposes the prayer for bail antecedent of the petitioner is not clean.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge if the charge is not framed yet and on being satisfied by the trial court that petitioner is not absconding in the cases pending against him which is mentioned below and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Kanti P.S. Case No. 407 of 2023 subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
