2. Petitioner seeks regular bail in connection with S.T. No. 387 of 2024 arising out of Belhar P. S. Case No. 527/2023 in a case registered for the offences punishable under Sections 304B, 120(B)/34 of the Indian Penal Code.
3. Prosecution story, in brief, is that marriage of the daughter of informant was solemnized with this petitioner in the year 2022. Thereafter, it is alleged that all the F.I.R. named accused persons including this petitioner started demanding dowry and committed torture and harassment due to nonfulfillment of the demand of dowry. On 21.12.2023 at about 8 PM, brother-in-law of the deceased telephonically informed the
Patna High Court CR. MISC. No.5911 of 2025(3) dt.02-05-2025 2/3 informant that her daughter has died. Informant alleges that the accused persons killed his daughter due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that petitioner, being husband of the deceased, denied the whole allegations levelled against him. He further submits that opinion regarding cause of death has been kept reserved awaiting FSL report. Informant has been examined as P.W. 1 and has not supported the prosecution case and has been declared hostile. P.W. 2 and P.W. 3 have also not supported the prosecution case. Petitioner is in custody since 27.05.2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering period of custody and deposition of the informant, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge 1-cum-Spl. Judge SC/ST (POA) Act, Banka in connection with Belhar P. S. Case No. 527 of 2023 corresponding to S. T. No.
