JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code .

Altogether 6 persons including the petitioner are named in the first information report on the accusation that they administered poison to informant's wife. Out of the aforesaid six named accused, five co-accused have already been granted privilege of anticipatory bail by a coordinate bench of this court by order dated 11-04-2016 passed in Cr. Misc. No. 5690 of 2016 but the petitioner was arrested during pendency of the aforesaid Cr. Misc. No. 5690 of 2016 and accordingly, his anticipatory bail petition was dismissed being infructuous.

Patna High Court Cr.Misc. No.21979 of 2016 (2) dt.20-05-2016 2/2 The allegation and the materials, which have been brought in this case, are almost similar against all FIR named accused.

Therefore, considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Tariyani P.S. Case No. 184 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Sheohar.
